Terms of service
Chaos to Clarity Digital Consulting LLC ("Chaos to Clarity," "we") builds and runs this app for Hersh Service Co ("the shop," "you"). These terms cover the shop and everyone the shop gives a login to. By using the app, you agree to them. If you don't agree, don't use the app.
If you and Chaos to Clarity have a separate signed agreement, that agreement wins wherever the two disagree.
What the app is
A phone app for running the shop: leads, the website chat assistant, scheduling, customer records, photos and files, reports and alerts. It's still being built. Features can change, move or go away, and things will sometimes break. When they do, use Ideas and problems in Settings and we'll work on it.
Your data is yours
Everything the shop and its customers put into the app belongs to the shop. That includes customers, leads, chats, the schedule, notes, photos and files. You give Chaos to Clarity permission to store and handle it only to run the app, back it up, support you, fix problems and keep it secure, or when the law requires it.
- We don't sell or rent your data, and we don't use it for advertising.
- We don't use your data to train AI models.
- We keep it confidential and only look at it when there's a reason to (like fixing something you reported).
- Each shop has its own separate database.
We may use counts that don't identify anyone (like how many chats the app handles) to run and improve the app.
Getting your data out
You can get a full copy of your data whenever you want:
- Connect Google Drive in Settings and the app saves a full copy (as data files and spreadsheets) to your own Drive every night.
- Or ask us, and we'll send you a full export within 30 days.
If you stop using the app, ask for your export first. We delete the shop's database within 60 days after the app is shut off for you. Anything already in your own Google Drive stays yours.
What the shop is responsible for
- Having the right to collect and use your customers' information, and using it lawfully.
- Following the rules on calls, texts and email to customers, including getting permission before sending marketing texts.
- Giving each person their own login, keeping passwords private, and turning off logins for people who leave (Settings > Team).
- Making sure what you tell the chat assistant (prices, services, hours, its dos and don'ts) is accurate and kept up to date.
- Not putting in information the app isn't built for: card or bank numbers, Social Security numbers, health records or similar.
- Checking leads, visits and messages before acting on them.
The chat assistant is AI
The chat assistant is off until the shop turns it on. When it's on, the website chat and replies to Facebook and Instagram messages are written by an AI model. It answers from what the shop puts in Settings > Shop (what it should know and its dos and don'ts) and from the conversation. It runs on prepaid chat funds the shop buys from Chaos to Clarity, and it stops answering when they run out. It can still get things wrong. It isn't a licensed tradesperson, it doesn't inspect anything, and it isn't a substitute for the shop's own judgment. Customers with an emergency should call the shop or 911. The shop decides what work to quote, schedule and do. Chaos to Clarity isn't responsible for what the assistant says to a customer or for decisions made because of it.
Other services the app uses
The app runs on outside services. Some are always on, others only if you connect them:
- Railway: hosting and the database (always)
- Anthropic: the AI behind the chat assistant (when it's on)
- Google: Drive for files and backups, Analytics numbers, and the contact form spam check (if connected)
- Meta: Facebook and Instagram messages (if connected)
- An email sending service: lead and confirmation emails (if set up)
- Apple, Google and Mozilla push services: phone alerts
- Any webhook or Zapier link you add yourself
Those services have their own terms. We pick them with care, but we don't control them, and we aren't responsible for their outages or mistakes.
Security
We take reasonable steps to protect your data: secure (HTTPS) connections, passwords stored scrambled (hashed), a separate database per shop, and access limited to the people who run the app. No system is perfectly secure. If we learn that someone got into your data without permission, we'll tell you without unreasonable delay and help you with what you need to do next.
No guarantees
The app is provided "as is" and "as available." To the fullest extent the law allows, Chaos to Clarity makes no warranties of any kind, express or implied, including that the app will be error free, always available, or fit for a particular purpose.
Keep your own copies of anything you can't afford to lose, like invoices and estimates.
Limits on liability
To the fullest extent the law allows, Chaos to Clarity isn't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, even if we were told they could happen. Chaos to Clarity's total liability for anything related to the app is limited to the greater of what the shop paid Chaos to Clarity for the app in the 12 months before the claim, or $100.
Covering each other
The shop agrees to cover Chaos to Clarity (including reasonable legal costs) for claims by customers or anyone else that come from the shop's use of the app, the information the shop puts in it, or the shop breaking these terms or the law.
Pricing
Pricing is whatever the shop and Chaos to Clarity have agreed to in writing. During a free pilot, there's no charge.
Ending things
Either side can stop at any time by telling the other. Chaos to Clarity can pause access if we need to protect the app, the shop's data or other shops, or if agreed fees aren't paid. "Getting your data out" above still applies after the end.
Changes to these terms
We may update these terms. For bigger changes, the office login will be asked to agree again in the app. Using the app after a change means you accept it.
The legal stuff
These terms are governed by the laws of the State of Michigan. Any dispute goes to the state or federal courts in Kent County, Michigan. If part of these terms can't be enforced, the rest still applies.
